Effective October 28, 2026
Marqup License Agreement
This agreement is between you and Enginuity, Inc. ("we", "us"), a California corporation, and covers the Marqup app for Mac ("the app"). By installing or using the app, you agree to it. The Terms of Use and Privacy Policy also apply.
1. Which agreement applies
App Store copies: if you got the app from Apple's App Store, Apple's Licensed Application End User License Agreement applies, and this agreement adds to it where the two do not conflict. Copies from marqup.app (including beta copies): this agreement applies in full.
2. License
We grant you a personal, non-exclusive, non-transferable license to install and use the app on the Macs, iPads and iPhones you own or control that your plan covers, for one person, for the plan you have (free, trial, one time purchase, yearly subscription or beta). A one time purchase is yours to keep, with no further fee. A subscription license lasts while the subscription is active. Beta copies may stop working on a set date or when we end the beta. The app is licensed, not sold; we keep all rights not granted here.
3. What you may not do
You may not: copy the app except to install it as allowed; sell, rent, lend, share or sublicense it; remove or get around its licensing, trial, beta or security features; reverse engineer, decompile or disassemble it, except where the law allows despite this limit; or use it to build a competing product.
4. Your files
You keep all rights to your documents and markups. The app works on your Mac and does not send your documents to us. You are responsible for having the right to open, mark up and share the files you use with it, and for keeping backups.
5. Professional use and checking results
Marqup does not check, approve or certify designs. Measurements, scales, counts, areas, volumes, compare and overlay results, text recognition, search, redaction and flattening depend on the PDF and on how the tools are used, and can be wrong. You must check results before relying on them, and you remain responsible for any work you prepare, review, sign, stamp, submit, bid or build. Look through every redacted file before sharing it.
6. Updates
We may release updates that add, change or remove features. Beta copies may update themselves or tell you to install a new version. Some updates may be needed to keep using the app.
7. Third-party components
The app includes open source software, such as qpdf and libjpeg-turbo, under their own licenses. Those licenses are listed in the app under About Marqup › Acknowledgments and govern those components.
8. No warranty
The app is provided "as is," with all faults. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement. We do not promise the app will meet your needs, work without interruption, or be free of errors.
9. Limit of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, time, bids, permits or project delays, arising from the app, even if told such damages were possible. Our total liability under this agreement is limited to the greater of the amount you paid for the app in the 12 months before the claim, or US $50.
10. Ending the license
This license ends automatically if you break it. When it ends, stop using the app and delete it. Sections 4, 5 and 8 through 12 continue after it ends.
11. Export
You may not use or export the app in violation of United States export laws or the laws of your country, or in a country or by a person the United States restricts.
12. General
This agreement is governed by California law, and disputes go to the state or federal courts in San Diego County, California. If any part cannot be enforced, the rest still applies. We may update this agreement; the new version will be posted on marqup.app with a new effective date.
