Terms of Use
These terms cover marqup.app, Marqup's plans and purchases, the free trial and the beta. Using the app itself is also covered by the Marqup License Agreement. How we handle information is in the Privacy Policy.
Marqup is made by Enginuity, Inc., a California corporation ("we", "us"). By using the site, signing up, or buying or using Marqup, you agree to these terms. If you use Marqup for a company, you agree for that company and confirm you may do so.
1. Your professional responsibility
Marqup is a tool for reviewing and marking up drawings. It does not check, approve or certify any design. Measurements, scales read from a sheet, counts, areas, volumes, compare results, search results, text recognition and redactions depend on the quality and accuracy of the PDF and on how the tools are used. You are responsible for checking every result before you rely on it, and for the work you submit, sign, stamp, bid or build. Flatten for Submittal prepares files for agency portals but does not guarantee any agency will accept a submittal. Always look through a redacted copy before you share it.
2. Plans and prices
- Free: open, view and navigate any set, the basic markups, and a limited number of measurements per file.
- Marqup Suite, one time: the full app on Mac, iPad and iPhone, for one person, including updates to this version that we release. It does not include separate future products or optional online services that we may offer for an added charge.
- Marqup Suite, yearly: the full app on Mac, iPad and iPhone, for one person, for as long as the subscription is active.
- Marqup Mobile, one time: the full app on iPad and iPhone, for one person. Owners of Marqup Mobile can move up to Marqup Suite with the Suite Upgrade.
- Firms: for several licenses, contact us.
Prices are shown on the site and in the App Store at the time of purchase and may change for future purchases or renewals. We will give notice before a price change applies to an existing subscription, as the App Store requires.
3. App Store purchases, renewals and refunds
Purchases are made through Apple's App Store and are also subject to Apple's terms. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You manage and cancel subscriptions in your Apple Account settings. Refunds are handled by Apple under its policies; we cannot issue App Store refunds ourselves. If your subscription ends or your trial runs out, you can still open and view everything you marked up.
4. Free trial
New users may get a 7 day free trial of the full app. If you do not cancel a trial of a subscription before it ends, the subscription begins and you are charged. Only one trial per person.
5. The beta
Beta copies are free, for testing, and may contain bugs. Keep backups of important files. A beta copy may stop working on a set date or when we end the beta, and we may turn it off remotely once the App Store version is available. Beta copies send anonymous usage statistics as described in the Privacy Policy. Please do not share your beta download link. Feedback you send us may be used to improve Marqup without any obligation to you.
6. Your account details
Give us accurate information when you sign up, keep your email address current, and keep your Apple Account secure. You are responsible for activity under your purchase.
7. Acceptable use
Do not use the site or app to break the law or anyone's rights, to mark up or distribute documents you have no right to use, to interfere with the site or our systems, or to copy, resell or redistribute Marqup except as the License Agreement allows.
8. Our content and names
The site, the app, its design, pictures and text are owned by Enginuity, Inc. or its licensors. Marqup and the Marqup logo are our trademarks. Other names on the site belong to their owners; mentioning them does not mean they endorse Marqup.
9. Disclaimer
The site and the app are provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise the app will be free of errors or work without interruption.
10. Limit of liability
To the extent the law allows, Enginuity, Inc. and its officers, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, time, bids, permits or project delays, arising from the site or the app, even if told such damages were possible. Our total liability for any claim is limited to the greater of the amount you paid for Marqup in the 12 months before the claim, or US $50. Some places do not allow these limits, so they may not fully apply to you.
11. Indemnity
If you use Marqup in a way that breaks these terms or the law, and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim.
12. Ending use
You can stop using Marqup at any time. We may suspend or end access to the beta or the site if these terms are broken. Sections 1 and 8 through 14 continue after use ends.
13. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in San Diego County, California, and you and we agree to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it.
14. Changes and general terms
We may update these terms. The new version will be posted here with a new effective date; continuing to use Marqup after that means you accept it. If any part of these terms cannot be enforced, the rest still applies. These terms, the License Agreement and the Privacy Policy are the whole agreement between you and us about Marqup.
